Terms of Service

Be Anonymous Technologies, Inc.

Please read these Terms carefully. They are a binding agreement between you and Be Anonymous Technologies, Inc. (“BatApps”, “we”, “us”). By downloading, installing, or using any of our applications or services, you agree to them. If you do not agree, do not use the Services.

1. The Services

These Terms cover BatApps, BatLine, BatSMS, and any other application, software, or website we make available (together, the “Services”).

  • BatApps creates and manages a separate Android profile on your device so that selected applications can be kept apart from, hidden from, or disabled alongside the rest of your phone.
  • BatLine provides secondary telephone numbers for calling and messaging, supplied through third party telecommunications carriers.
  • BatSMS is a messaging application for standard SMS and MMS.

Our Privacy Policy explains what information the Services collect and is incorporated into these Terms.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to purchase a subscription or obtain a telephone number through the Services. The Services are not directed at children under 13. If you use the Services on behalf of an organization, you represent that you are authorized to accept these Terms for it.

3. Your PIN and Your Access

BatApps protects access with a PIN that is set by you and stored, encrypted, on your own device. We do not have a copy of it and we cannot reset or recover it. This is a deliberate property of the design rather than a limitation we can waive: if you lose your PIN, neither you nor we can recover access to the protected profile or anything kept inside it.

You are responsible for keeping your PIN confidential and for all activity that occurs on your device. Because we have no account system and hold nothing that identifies you, we cannot verify ownership of an installation and cannot restore access to one.

4. Device Administration

To create a separate profile, BatApps must be granted Android device-administration privileges and acts as the profile owner for the profile it creates. You may remove those privileges at any time through your device settings, and you may remove the profile at any time from within BatApps.

Removing the profile permanently deletes the applications and data inside it. That deletion is performed by Android, is irreversible, and cannot be undone by us. Keep your own copies of anything you would not want to lose.

5. Subscriptions, Billing and Cancellation

Some features require a paid subscription. Subscriptions are sold and processed by Google Play or the Apple App Store, not by us. We never receive your card number or payment details.

Subscriptions renew automatically for successive periods at the then-current price until cancelled. You cancel through the store you purchased from — Google Play or the App Store — and cancellation takes effect at the end of the paid period. Uninstalling an application does not cancel a subscription.

Refunds are governed by the policies of the store that processed the purchase. Where a free trial is offered, it converts to a paid subscription unless cancelled before it ends. If a renewal payment is declined, access to paid features may be suspended or removed.

We may change subscription pricing. Price changes apply from the next renewal after notice is given through the applicable store.

6. Telephone Numbers and Messaging

Numbers issued through BatLine are provided by third party carriers and are licensed to you for the duration of your subscription, not owned by you. You cannot port a number out, and you have no property right in it.

If your subscription lapses or you release a number, that number returns to the carrier and may be reassigned to another person. Messages or calls sent to it afterwards may reach someone else. We cannot guarantee that a released number can be recovered.

You agree to use the numbers only for lawful, one-to-one personal communication. You may not use them for bulk, automated, or unsolicited messaging, marketing campaigns, robocalls, or any purpose prohibited by applicable law or by carrier and industry messaging rules. You must honour opt-out requests from anyone you contact.

The Services dynamically support standard network opt-out keywords. If an external message recipient replies to a BatLine number with the keyword STOP, the message bridge will automatically terminate to prevent further outreach from that number.

7. Emergency Services Are Not Available

BatLine does not support calls to 911 or any other emergency service number. It is not a replacement for your mobile carrier or a landline. Do not rely on it to contact emergency services. Always maintain an alternative means of placing emergency calls.

8. Acceptable Use

The Services are provided strictly for individual, 1-to-1 conversational use between willing participants who have mutually consented to communicate. You agree to use the Services only for lawful, personal, and human-to-human communications.

You may not use the Services to:

  • break the law, or help anyone else do so;
  • harass, threaten, stalk, defraud, or impersonate any person;
  • send spam, chain messages, or unsolicited commercial communications;
  • send messages related to high-risk financial marketing, debt collection, credit repair, or multi-level marketing scheme recruitment;
  • transmit content promoting illegal substances, cannabis, vaping, firearms, adult services, or hate speech (compliant with global telecom infrastructure restrictions);
  • evade a block, a restraining order, or a lawful investigation;
  • infringe anyone’s intellectual property or privacy rights;
  • interfere with, overload, or attempt to gain unauthorized access to the Services or the systems of our providers;
  • reverse engineer, decompile, or attempt to derive source code from the Services, except where that restriction is prohibited by law or permitted by the licence of an open source component;
  • resell, sublicense, or make the Services commercially available to third parties without our written agreement.

We may suspend or terminate access for conduct that violates this section.

9. Your Content

Anything you create, send, or store using the Services belongs to you. We do not store your content and cannot read it. You are solely responsible for it and for keeping your own backups.

Because content resides on your device and inside an encrypted profile we have no access to, we cannot retrieve, restore, or produce it — for you or for anyone else.

10. Intellectual Property

The Services, and all software, designs, text, and trademarks in them, are owned by Be Anonymous Technologies, Inc. or its licensors. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Services on devices you control.

All rights not expressly granted are reserved. Portions of the Services include third party open source software, which remains governed by its own licence terms.

11. Third Party Services

The Services depend on third parties we do not control — including Google Play and the Apple App Store, telecommunications carriers, and, where you enable it, the Tor network. Their acts, outages, policies, and terms are outside our control, and we are not responsible for them.

12. Availability and Changes

We may modify, suspend, or discontinue any part of the Services at any time. We aim to give reasonable notice of material changes but cannot always do so. The Services are not guaranteed to be uninterrupted or error-free, and may be unavailable during maintenance, carrier incidents, or events beyond our control.

13. Termination

You may stop using the Services at any time by uninstalling them and cancelling any subscription through the applicable store. We may suspend or terminate access if you breach these Terms, if required by law or by a provider, or if we discontinue a Service.

On termination, your licence ends and any telephone numbers issued to you are released. Sections that by their nature should survive — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Indemnification — continue to apply.

14. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, or error-free, that messages or calls will be delivered, or that any particular level of privacy or concealment will be achieved on every device, operating system version, or network. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BE ANONYMOUS TECHNOLOGIES, INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED US DOLLARS.

Some jurisdictions do not allow these limitations, so they may not apply to you in full.

16. Indemnification

You agree to indemnify and hold harmless Be Anonymous Technologies, Inc. and its officers, employees, and agents from any claim, demand, loss, or expense, including reasonable legal fees, arising out of your use of the Services, your content, or your breach of these Terms or of any law or third party right.

17. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. The courts located in Miami-Dade County, Florida will have exclusive jurisdiction over any dispute, and you and we consent to their jurisdiction and venue, except where applicable consumer law gives you the right to bring proceedings elsewhere.

18. Changes to these Terms

We may update these Terms. When we do, we will revise the date at the top of this page, and where the change is material we will give notice through the Services or on this website. Continuing to use the Services after a change takes effect means you accept the revised Terms.

19. General

If any provision of these Terms is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Services.
